Terms of Service

I. Preamble & Legal Binding

This Master Service Agreement (the "Agreement") is a legally binding instrument executed between Kansaraix (OPC) Private Limited (hereinafter "Kansaraix," "the Platform Provider," or "the SaaS Provider") and the entity or individual (hereinafter "User," "Student," or "Partner Company") accessing the proprietary digital infrastructure hosted at Kansaraix.com.

Notwithstanding any prior communications, oral or written, your utilization of the Platform constitutes an irrevocable acceptance of these Terms. Access to the Platform is contingent upon your absolute compliance with the covenants herein. Kansaraix reserves the unilateral prerogative to amend, modify, or abrogate any provision within this instrument without prior notification.

II. SaaS Ecosystem Provisions

Kansaraix provides a Software-as-a-Service (SaaS) solution encompassing a proprietary Learning Management System (LMS), Enterprise Resource Planning (ERP) tools for educational organizations, and secure data orchestration services.

Users are granted a limited, non-exclusive, non-transferable, and revocable license to access the SaaS environment pursuant to the service tier or course enrollment acquired. Kansaraix warrants a best-effort availability of the Platform infrastructure, subject to force majeure events and scheduled maintenance protocols.

III. Marketplace & Intermediary Role

Kansaraix operates strictly as a digital marketplace and SaaS facilitator. The internship programs, instructional modules, and mentorship services available heretofore are independently authored and delivered by autonomous Partner Companies. Consequently:

Kansaraix disclaims all warranties regarding the academic accuracy, pedagogical efficacy, or qualitative standards of the content provided by third-party partners.
The Partner Company is the primary obligor regarding the fulfillment of internship promises, mentorship access, and project evaluation.

IV. Financial Mandates & Non-Refundability

All financial considerations paid to Kansaraix or its Partners for access to the Platform are strictly non-refundable, non-negotiable, and non-reversible. This provision is absolute and prevails over any subsequent claims of disinterest, technical incapacity, or circumstantial impediments.

By completing a transaction, the User explicitly waives the right to initiate chargebacks, dispute resolutions via financial intermediaries, or consumer litigation regarding fee reversals. Enrollment represents an acknowledgment of immediate intellectual property delivery.

V. Intellectual Property Indemnification

The Platform's source code, proprietary algorithms, UI/UX architecture, and brand indicia are the exclusive property of Kansaraix. Users shall not engage in reverse engineering, unauthorized data harvesting (scraping), or systematic replication of the Platform's features.

Course materials (videos, documents, tasks) are protected by copyright laws. Unauthorized distribution, communal sharing of credentials, or commercial exploitation of learning materials will result in immediate legal prosecution and summary termination of access.

VI. Limitation of Liability & Indemnity

To the maximum extent permitted by law, Kansaraix disclaims all liability for any incidental, consequential, or punitive damages arising from the use or inability to use the Platform.

The User agrees to indemnify, defend, and hold harmless Kansaraix and its officers from any claims, liabilities, or expenses (including legal fees) arising from the User's violation of this Agreement or the infringement of third-party rights.

VII. Jurisdiction & Dispute Resolution

This Agreement shall be construed in accordance with the laws of the Republic of India.

Any legal proceedings or adjudications arising out of or in connection with this instrument shall be vested exclusively in the competent courts of Rajasthan, India. The User hereby consents to the personal jurisdiction of such courts and waives any objections regarding forum non-conveniens.

Confidentiality Policy

01. Classification of Confidential Information

For the purposes of this Statute, "Confidential Information" encompasses all non-public data heretofore disclosed within the Platform, including but not limited to: proprietary source codes, instructional methodologies, curriculum structures, internal financial telemetry, Partner Company strategies, and User-specific performance analytics.

02. The Non-Disclosure Mandate

"Every User and Partner Company shall maintain the strictest confidentiality regarding all proprietary information acquired through the Platform."

Utilization of the Platform constitutes an irrevocable agreement to refrain from disseminating, replicating, or commercially exploiting any Confidential Information without the express, written authorization of Kansaraix (OPC) Private Limited. This obligation survives the termination of any individual enrollment or partnership agreement.

03. Protection of Pedagogy & Trade Secrets

The learning materials, instructional videos, and assessment rubrics provided by Partner Companies are protected trade secrets. Users are strictly prohibited from utilizing "screen-recording" technologies, unauthorized downloading, or the systematic extraction of data from the SaaS environment. Any breach of this covenant will be interpreted as industrial espionage and prosecuted accordingly.

04. Data Anonymization Protocols

Kansaraix reserves the right to aggregate and anonymize Platform usage data for research and optimization purposes. Notwithstanding this, no PII (Personally Identifiable Information) shall be disclosed to third-party entities, pursuant to the stringent protocols defined in our Privacy Charter.

05. Exemption: Legal Compulsion

The confidentiality obligations herein shall not apply to information that is required to be disclosed by a court of competent jurisdiction or a governmental authority. In such an event, Kansaraix shall provide notice to the affected party, provided such notice is not legally prohibited.

Disclaimer Policy

I. The "As-Is" Provision

"Kansaraix (OPC) Private Limited provides the Platform, its SaaS infrastructure, and all associated digital resources strictly on an 'AS-IS' and 'AS-AVAILABLE' basis."

Kansaraix hereby disclaims all warranties, express or implied, including but not limited to the implied warranties of merchantability, fitness for a particular purpose, and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free, or entirely secure.

II. Intermediary Content Disclaimer

Kansaraix operates as a SaaS Facilitator and Digital Intermediary. The instructional content, pedagogical strategies, and internship deliverables heretofore available are provided by autonomous Partner Companies.

KANSARAIX DOES NOT VET, VALIDATE, OR ENDORSE THE ACADEMIC QUALITY OR ACCURACY OF THIRD-PARTY CONTENT.

Any reliance you place on such information is strictly at your own risk. Kansaraix shall not be liable for any academic failures, career outcomes, or placement expectations resulting from the use of the Platform.

III. Limitation of Statutory Liability

To the maximum extent permitted by applicable law, in no event shall Kansaraix, its directors, or its affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from:

Your access to or use of (or inability to access or use) the Platform.
Any conduct or content of any Partner Company or third party on the Platform.
Unauthorized access, use, or alteration of your transmissions or content.

IV. No Professional Advice

The information provided on the Platform is for educational purposes only and does not constitute professional, legal, financial, or engineering advice. Kansaraix does not guarantee any specific career outcome or employment status upon the completion of any program.

Student Learning Policy

01. Purpose of Free Learning Content

KANSARAIX may provide free learning video links and educational resources to help students upskill and improve their knowledge. These resources are provided purely for educational and self-learning purposes.

02. YouTube & External Video Redirection

Some educational videos, training materials, or course content on KANSARAIX may redirect you to YouTube or other external video platforms. This is done to provide high-quality learning resources efficiently.

03. Self-Learning Without Application

Students have the liberty to watch these free learning videos without formally applying or registering for any specific internship or training program. Watching these videos is entirely for self-improvement.

04. No Official Enrollment Through Video Watching

Please be aware that simply watching free YouTube videos or external content via KANSARAIX does not automatically create any official relationship with us. It does not count as official internship enrollment, training enrollment, job guarantee, job offer, placement, or any official claim. If a student wishes to officially participate in an internship, training, or program, they must follow the official website application and registration process.

05. External Platform Responsibility

External platforms such as YouTube are governed by their own independent Terms of Service. They may have their own advertisements, video recommendations, comment sections, privacy policies, and content availability rules. KANSARAIX has no control over these external platform features.

06. Changes or Removal of Videos

KANSARAIX is not responsible if YouTube or any other external platform removes, blocks, changes, or restricts a video. Video availability is entirely dependent on the original uploader and the external hosting platform.

07. Student Usage Rules

Students are expected to use the provided content ethically and strictly for learning purposes. Students must not misuse, copy, reupload, sell, or redistribute any video, material, or intellectual property without explicit written permission from the content owner.

Company Content Responsibility Policy

01. Purpose of This Policy

This policy clearly outlines the legal responsibilities of companies that upload, share, embed, submit, or provide video and content links through the KANSARAIX platform. It establishes the boundaries of ownership, copyright, permissions, and the legality of the provided content.

02. Company Responsibility for Submitted Content

Any company that uploads, submits, or provides video content, YouTube links, embedded videos, training material, documents, images, text, or other educational content on KANSARAIX is fully and solely responsible for that content.

03. Ownership, Copyright and Permission

The company must ensure they own the content or have proper, documented legal permission or license to use it. By submitting content, the company explicitly confirms that the content is either original, authorized, licensed, or legally permitted for public sharing and educational display.

04. Third-Party Content and Legal Claims

If the company uses someone else's video, image, document, music, voice, brand, logo, copyrighted material, or third-party content without permission, the full legal responsibility will fall entirely upon that company. If any legal claim, copyright strike, or dispute arises due to company-provided content, the company is obligated to handle and resolve it at its own cost and responsibility.

05. KANSARAIX Role as Platform

KANSARAIX operates solely as an educational facilitator and platform provider. KANSARAIX will not be held responsible or liable for any copyright claims, ownership disputes, takedown notices (such as DMCA), legal notices, damages, penalties, or third-party claims caused by content submitted by a company.

06. Right to Remove or Reject Content

KANSARAIX retains the absolute right to remove, disable, hide, or reject any content that appears illegal, misleading, copyrighted without authorization, harmful, inappropriate, or disputed. Furthermore, KANSARAIX may at any time ask the company to provide verifiable proof of ownership, permission, or licensing for their uploaded content.

07. Prohibited Content

Companies must not upload, share, or embed any content that is misleading, illegal, adult-oriented, hateful, violent, harmful, pirated, or unauthorized. Any violation of this rule will result in immediate content takedown and potential suspension of the company's account.

08. Compliance With Laws and Platform Rules

The company is entirely responsible for ensuring their content strictly follows Indian law, IT rules, copyright acts, and YouTube's terms of service/policies (where applicable), along with any other applicable international or local laws.

09. Indemnity / Hold Harmless

By utilizing the KANSARAIX platform, the company agrees to indemnify, defend, and hold KANSARAIX, its directors, employees, and affiliates harmless against all claims, liabilities, damages, losses, or expenses (including legal fees) arising out of or in connection with the company-submitted content.

10. Contact & Reporting Content Issues

If you believe any content on KANSARAIX violates your copyright or intellectual property rights, please contact our administrative team immediately at nirmalkumarthathera@gmail.com to initiate a takedown review.

Privacy Policy

01. Statement of Data Stewardship

Kansaraix (OPC) Private Limited ("the SaaS Provider") recognizes the sanctity of User data and is committed to implementing rigorous data stewardship protocols. This Privacy Charter delineates the methodologies pursuant to which we collect, safeguard, and utilize data acquired via the Kansaraix SaaS platform.

02. Scope of Data Acquisition

Kansaraix collects information necessary for the efficacious delivery of SaaS-based educational services. This includes, but is not limited to:

Personal Identifiable Information (PII): Full nomenclature, electronic mail addresses, telephonic identifiers, academic credentials, and institutional affiliations.
Transactional & Log Data: Payment history, interaction logs, Internet Protocol (IP) addresses, browser telemetry, and Platform engagement metrics.

03. Legal Basis for Data Processing

Pursuant to international data protection standards, data processing is conducted solely for:

Contractual Fulfillment: Orchestrating the delivery of courses and certifications purchased from Partner Companies.
Infrastructure Integrity: Mitigating fraudulent activities and ensuring the security of the SaaS environment.
Service Optimization: Utilizing anonymized telemetry to enhance the Platform's pedagogical efficacy and technical performance.

04. Marketplace Information Sharing

As an intermediary SaaS provider, Kansaraix facilitates information exchange between Students and Partner Companies. By enrolling in a specific program, you authorize Kansaraix to transmit relevant identifiers (e.g., name, email, progress) to the Registered Partner Company managing that program. Notwithstanding the foregoing, Kansaraix does not divulge personal data to unauthorized third-party marketing entities.

05. Cybersecurity & Encryption

Kansaraix employs sophisticated cybersecurity measures, including industry-standard Transport Layer Security (TLS) encryption, secure hash algorithms, and multi-layered access controls. While no digital infrastructure is impervious to intrusion, we maintain high-availability security monitoring to preempt and neutralize potential vulnerabilities.

06. Statutory Rights of the Data Subject

Subject to legal exemptions, Users may exercise the right to access, rectify, or request the cessation of processing of their personal data. Requests must be formally submitted to our Data Protection Officer at nirmalkumarthathera@gmail.com for verification and orchestration.

07. Charter Amendments

Kansaraix reserves the sovereign right to amend this Privacy Charter at any interval to align with evolving regulatory frameworks and operational requirements. Continued utilization of the SaaS Platform following such amendments signifies your tacit approval of the revised Charter.

Refund Policy

I. The Irrevocability Covenant

Kansaraix (OPC) Private Limited maintains an absolute, zero-tolerance, and non-negotiable policy regarding the refundability of fees. Upon the successful orchestration of a payment transaction via our secure gateways, the consideration paid becomes strictly non-refundable and non-transferable.

This irrevocability is heretofore established because the enrollment process triggers the immediate delivery of proprietary intellectual property, licensing access to the SaaS infrastructure, and administrative allocation within the Partner Company's educational ecosystem.

II. Scope of Universal Applicability

The non-refundability mandate remains in full force and effect, notwithstanding any of the following occurrences:

Voluntary disinterest or cessation of learning by the User post-enrollment.
Technical impediments residing within the User's local hardware or network infrastructure.
Overlapping academic schedules, examinations, or personal temporal constraints.
Erroneous course selection or misunderstanding of program prerequisites.

III. Waiver of Dispute Rights

By initiating a transaction on the Kansaraix Platform, you expressly and irrevocably waive all statutory and contractual rights to initiate chargebacks, dispute resolutions, or litigation for fee reversals via banking institutions, payment intermediaries, credit card issuers, or consumer arbitrators.

IV. Intermediary Disclosure

As Kansaraix operates as a SaaS facilitator, any claims regarding program delivery or content quality must be directed to the Partner Company providing the course. Kansaraix, in its capacity as the Platform Provider, does not exercise unilateral control over the financial assets once they are allocated to the Partner Company's account for service delivery.
